I am voluntarily submitting the recording of my name, voice, likeness, appearance and related materials (collectively, the “Recording”) in connection with the “Hear Her Out” Project (the, “Project”) produced by Recreational Equipment, Inc. (“REI”). I understand that I may either submit my Recording on the Project website located at www.hearherout.com (the “Website”) or record it in person at a Project-related event. By submitting my Recording (via the Website and/or in person), I the undersigned consent to the audio and video recording of my name, voice, likeness and appearance including any information and content I provide therein. I further consent to the distribution, broadcast and public performance of my Recording, in whole or in part, as a part of or in connection with the Project, or the marketing, advertising and promotion thereof in any and all media, including without limitation in audio, video, or text form, without restriction. I acknowledge and agree that the rights granted in this release are in addition to any fair use or other rights REI would enjoy in my Recording if this release were not in effect.
I further acknowledge and agree:
a) I will receive no monetary compensation for my Recording.
b) REI’s use of my Recording will not violate or infringe upon the rights of any third party.
c) I am waiving any intellectual property claims including, but not limited to, trademark and copyright infringement claims associated with personal or business interests discussed during my Recording.
d) I am waiving any right to publicity and privacy claims, and agree my name, voice, likeness, and business and
biographical information may be used by REI in accordance with this release.
e) I hereby agree that the Recording is not subject to any obligation, whether of confidentiality, attribution, or
otherwise, on REI’s part and REI shall not be liable for any use or disclosure of the Recording. In connection
therewith, I hereby release REI from any and all claims of any kind arising from the use of the Recording
permitted herein.
f) I acknowledge and agree that REI has the right to edit the content of my Recording and publish the same in
any media now and in the future without first obtaining my approval and also has the right to transcribe and
publish my Recording in any and all media, now known, or hereafter devised.
g) REI may assign, transfer, license, delegate and/or grant all or any part of its rights, privileges, and/or obligations
hereunder to any person or entity, and this release shall be binding upon and shall inure to the benefit of the
parties hereto and their respective successors and assigns.
h) I am releasing and discharging REI together with all of REI’s principals, shareholders, officers, employees,
agents, successors, and assigns from any and all liability arising out of or in connection with my Recording
in connection with the Project or the marketing, advertising thereof.
i) This Release contains the full and complete understanding between us with respect to the Recording and cannot
be modified except by a writing signed by REI.
By physically or electronically signing this release, I hereby acknowledge and agree to the foregoing.
